Your access to and use of this site and other linked bestpubs sites operated by us (collectively, the "BP site") is subject to these terms and our Privacy Policy ("Terms "). We recommend that you carefully read these Terms before you use the BP site. These Terms apply generally to all users of the BP site. However, there are specific clauses that apply only to Site Members and Venue Owners/Managers. |

THE SITE

The BP site is an online advertising medium that advertises Licensed Venues, upcoming events and promotions at licensed venues, Licensed Venues for sale and allows Site Members to post reviews about their experience at a Venue. |

We are not involved in the actual listing of Venues, the listing of events or promotions at Licensed Venues, the listing of Venues for sale or the listing of Venue reviews. We are merely a passive conduit for the on-line distribution and publication of such information. As a result, we have no control over and, to the extent permitted by law, make no warranties in relation to, the suitability, quality, safety or legality of any advertising or reviews, or the accuracy or truth of any listings on the BP site. Members and Guest users of the site are urged to check the details listed about a particular Venue with the Venue itself before relying on such information. |

|
Copyright in the content on the BP site and in the BP site itself (as a compilation of information) is owned by us, our advertisers or content suppliers. |

USAGE RULES
|
You must comply with these Terms when accessing and using the BP site. |

You warrant to us that you will not use the BP site for any purpose that is unlawful, untrue or prohibited by these Terms. |

You may download and print individual advertising listings from the BP site for your own private, non-commercial use. Apart from this, you must not use, reproduce, communicate, publish, or distribute any of the content on the BP site, unless this constitutes a fair dealing for the purposes of the Copyright Act 1968 (Cth). |

In particular you must not data mine or conduct automated searches on the BP site or the content on the BP site, whether through the use of additional software or otherwise. In addition you must not incorporate any of the content on the BP site with any other material, including advertising or promotional material. |

You must not use the BP site or any facilities available on the BP site for any activities, or transmit to or via the BP site any information or material (including submitting listings or reviews), which breach any laws or regulations, breach these Terms, infringe a third party's rights (including intellectual property rights, rights of privacy or their trade secrets), are inappropriate, offensive, obscene, threatening, indecent, inflammatory, pornographic, defamatory or confidential, are false or misleading are discriminatory in breach of State or Commonwealth anti-discrimination legislation, or identify a person or which can be used to identify a person (including any copy, photos or other pictorial representations) unless you have obtained that person's authority. |

You must not use the BP site or any facilities available on the BP site to defame, harass, threaten, menace or offend any person; tamper with, hinder the operation of, or make unauthorised modifications to the BP site or any content on the BP site; knowingly transmit any virus, worm, Trojan horse or other disabling feature to or via the BP site; or use the BP site to send commercial, unsolicited or bulk electronic messages to anyone or in any other way which would constitute an infringement of the Spam Act 2003 (Cth) |

We may withdraw or alter any material you provide us (including any reviews you submit as part of a Service and if you are a Venue Owner/Manager or Agent of, any listings submitted by you) if we reasonably consider it is inappropriate, offensive, misleading or deceptive, defamatory, incorrect or in any other way in breach of these Terms, any law or third party rights or we are instructed to do so by any third party or relevant Government law enforcement agency. We will tell you if we do this and if you are a Venue Owner/Manager and we withdraw or alter your listing and the cost of your listing would be lower as a result, we will refund you the difference. |

MINIMUM AGE
|
You must be at least 18 years of age to view the BP site and to join as a Venue Owner/manager or a Site Member and to place anything on the site, whether this be a listing or a review. |

VERIFICATION
|
In order to maintain the integrity of the BP site we reserve the right (but are not required) to verify all listings on the BP site, and to verify the information contained in any reviews. You agree that we may access your records and systems and/or contact you for the purposes of verification or clarification. You agree to provide such additional information as we reasonably require. |

OTHER WEBSITES
|
The BP site may contain links to other websites which are not maintained or controlled by us or our related companies ("third party site"). Third party sites are not part of the BP site. These links are provided by us solely for your convenience. |

We make no representations or warranties whatsoever about any third party site. We do not endorse, and accept no responsibility for, the content or use of any third party site. If you link to any third party site, you leave the BP site and do so entirely at your own risk. |
